Terms of Service

These Terms of Service form an agreement between you and the operator of TalkSearch (referred to as “TalkSearch,” “we,” “us,” or “our”). By accessing or using TalkSearch, creating a developer account, acquiring credits, or using an API key, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service. If you use TalkSearch for an organisation, you confirm that you have authority to bind that organisation, and “you” includes both you and that organisation.

TalkSearch provides search, discovery, and programmatic access to an independently indexed collection of public Bitcointalk content. Features may include post and image search, cached media, nearby replies, and retrieval of posts, topics, profiles, or related metadata by identifier.

TalkSearch is independent from Bitcointalk and is not endorsed by, operated by, or part of Bitcointalk. Search rankings, quality labels, spam filtering, language classification, image labels, and other derived signals are automated assessments and may be incomplete or wrong.

You must be legally capable of entering this agreement. If the law where you live requires you to be older than 18 to enter an online service contract, you may use account or paid features only after reaching that age or with valid permission from a parent or legal guardian.

You may not use TalkSearch if applicable law prohibits us from supplying the service to you or prohibits you from receiving it.

Provide accurate account information and maintain access to your registered email address. You may not impersonate another person, create accounts through deceptive means, sell accounts, or use an account after we have suspended it.

You are responsible for safeguarding your credentials, sessions, and API keys and for activity performed through them. Notify support@talksearch.io promptly if you suspect unauthorised access. We may invalidate sessions or keys when reasonably necessary to protect you, TalkSearch, or other users.

Subject to these Terms, TalkSearch grants you a limited, non-exclusive, revocable, non-transferable right to call the documented API from your applications. The current endpoints, authentication methods, response formats, rate limits, and metering behaviour are described in the developer documentation.

API keys are credentials. Do not publish, share, sublicense, sell, or embed them in publicly delivered client code. You may create separate keys, set expiration dates, restrict source IP addresses or ranges, renew keys, and revoke them through the developer dashboard.

You are responsible for ensuring that your application handles errors, retries, timeouts, pagination, rate-limit headers, and API changes safely. A published schema or example is documentation, not a guarantee that every indexed record contains every field.

Developer API access uses prepaid credits on a pay-as-you-go basis. Current conversion rates, minimum and maximum top-up amounts, promotional bonuses, and supported payment methods are displayed before purchase and in the developer area. Checkout may support direct cryptocurrency payments and third-party swap routes.

A completed metered request normally charges the number of credits shown by the X-Credits-Charged response header. Requests rejected before metering, missing resources, and service failures are not charged; if a credit was reserved before a failed upstream request, the ledger returns it automatically. Your dashboard balance and ledger are the authoritative usage record unless you show a billing error.

Cryptocurrency payments are credited after the checkout processor reports settlement. Blockchain confirmations, network fees, payment routing, exchange rates, slippage, and third-party swap availability are outside our control. Sending an unsupported asset or using an incorrect network may result in permanent loss.

Credits are a limited contractual right to use TalkSearch. They are not money, a deposit account, electronic money, an investment, or a cryptocurrency; they do not earn interest and may not be transferred or resold. Promotional credits have no cash value. You are responsible for taxes associated with your purchase or use.

Except where applicable law requires otherwise, settled top-ups are non-refundable because cryptocurrency transfers are irreversible. We will correct verified billing errors. If we permanently discontinue paid API access without offering a substantially equivalent service, we will provide a reasonable way to use or seek reimbursement for unused purchased credits, subject to applicable law and payment feasibility.

You must use TalkSearch and its data lawfully and responsibly. You must not:

• attack, overload, disrupt, probe, or bypass security, authentication, access controls, rate limits, or usage metering;
• use automated means against undocumented website interfaces when a documented API is provided for that activity;
• introduce malware, malicious instructions, or code intended to damage TalkSearch or another system;
• use results to harass, threaten, dox, unlawfully discriminate against, or facilitate harm to a person;
• send spam, conduct fraud, violate privacy or data-protection law, or infringe intellectual-property or other third-party rights;
• misrepresent TalkSearch data as verified fact, conceal material alterations, or falsely imply endorsement by TalkSearch or Bitcointalk;
• resell credentials or credits, operate a competing proxy that evades pricing or controls, or assist another person in violating these Terms.

Reasonable security testing requires our prior written permission. Contact us before testing a suspected vulnerability against production systems.

Forum posts, usernames, links, images, and other source material are created or supplied by third parties. TalkSearch does not control, adopt, verify, or endorse that material. Results may be offensive, unlawful, inaccurate, outdated, unsafe, or unsuitable for your purpose, even when filters are enabled.

Source material remains subject to the rights and rules that apply at its origin. TalkSearch does not grant you ownership of third-party content or permission to use it beyond what applicable law or the relevant rights holder allows. Follow result links and verify important information at the original source.

Cached images and rendered excerpts exist to support search and retrieval. Rights holders and affected persons may submit a reasoned request through Report content or by email. We may remove, restrict, or de-index material while reviewing a valid legal, safety, privacy, or intellectual-property request.

TalkSearch and its licensors retain rights in the service software, interface, branding, documentation, original text, ranking systems, derived metadata, and other materials we create. Except for the limited API right in section 5, these Terms do not grant a licence to our trademarks, source code, private datasets, or infrastructure.

If you voluntarily send feedback, you permit us to use it without restriction or payment, but you keep ownership of any rights you already hold in it. This permission does not cover confidential information that we agreed in writing to receive as confidential.

We aim to operate TalkSearch reliably, but no service-level agreement applies unless we sign one separately. Search coverage, indexing delay, ranking, filters, endpoints, fields, quotas, prices, and supported payment routes may change as the corpus, abuse patterns, costs, and technology change.

We may perform maintenance, respond to emergencies, remove unsafe features, or temporarily limit service. Where reasonably practical, we will document material API changes and avoid unnecessarily breaking supported integrations. We are not responsible for failure or delay caused by Bitcointalk, blockchain networks, payment or swap providers, hosting providers, internet failures, attacks, legal orders, or other events outside our reasonable control.

You may stop using TalkSearch at any time and may revoke keys from the dashboard. Contact support to request account closure, subject to records we must retain for security, accounting, dispute resolution, or legal compliance.

We may rate-limit, suspend, or terminate access when we reasonably believe that you breached these Terms, created security or legal risk, failed to pay, abused the service, or used the service fraudulently. We may act immediately for urgent security, abuse, or legal reasons. Otherwise, where reasonable, we will provide notice and an opportunity to address the issue.

If we terminate a paid account without cause, we will provide a reasonable opportunity to use or seek reimbursement for unused purchased credits. If termination results from fraud, a payment reversal, or a material breach, unused credits may be cancelled to the extent permitted by law. Sections that by their nature should continue—including payment obligations, intellectual property, disclaimers, liability, disputes, and general terms—survive termination.

TalkSearch is supplied using reasonable care and skill. Because it depends on changing third-party content and systems, we do not promise that the service will always be uninterrupted, error-free, secure, complete, current, or fit for every particular purpose. Automated labels, rankings, translations, summaries, classifications, and filters require independent judgment.

Nothing in these Terms excludes, restricts, or overrides a warranty, guarantee, remedy, or other right that applicable law says cannot be excluded or restricted. If you are a consumer, your mandatory statutory rights remain in force.

Each party remains responsible for loss that it causes and that applicable law makes it responsible for. TalkSearch is not responsible for loss caused solely by third-party content, your failure to secure credentials, your unlawful or unauthorised use, unsupported integrations, or events outside our reasonable control.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any other liability that applicable law does not allow to be limited. Consumer remedies and liability are not limited where doing so would be unlawful or unfair.

This section applies only when you use TalkSearch mainly for a trade, business, craft, profession, or organisation and not as a consumer.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings, or data, except where that loss results from fraud, wilful misconduct, breach of confidentiality, infringement, or an obligation that cannot lawfully be limited. TalkSearch’s aggregate liability arising from the paid service is limited to the greater of US$100 or the amount you paid for TalkSearch credits during the 12 months before the event giving rise to the claim.

You will reimburse TalkSearch for reasonable losses, liabilities, and costs finally awarded or agreed in settlement of a third-party claim caused by your application, your content, or your material violation of section 7, provided we promptly notify you and allow you reasonable control of the defence. You have no obligation to the extent the claim was caused by TalkSearch.

Contact support@talksearch.io first and include enough information for us to investigate. We will try in good faith to resolve billing, account, content, or service complaints directly.

These Terms do not require a consumer to give up access to a regulator, ombudsman, court, tribunal, collective remedy, or dispute process available under mandatory law. The law and courts that have jurisdiction are determined by applicable law and the parties’ circumstances; we do not impose a different jurisdiction through these Terms.

We may update these Terms to reflect service changes, security needs, legal requirements, or clearer wording. The effective date at the top identifies the current version. For a material change affecting paid accounts, we will provide reasonable advance notice through the website, dashboard, or registered email unless an urgent legal or security reason requires faster action.

Changes apply prospectively. Continuing to use the affected service after the stated effective date means you accept the updated Terms. If you do not accept them, stop using the service and contact us before the effective date about any unused purchased credits. A change to these Terms does not remove mandatory rights or retroactively change a completed transaction where the law forbids it.

These Terms, the Privacy Policy, the pricing presented at purchase, and any written service-specific terms form the agreement about TalkSearch. If a court finds part of these Terms unenforceable, the remainder continues to apply, and the affected part will be interpreted as narrowly as necessary to make it enforceable where permitted.

A delay in enforcing a term is not a waiver. You may not assign your account or this agreement without our written consent. We may assign the agreement as part of a reorganisation, financing, merger, acquisition, or transfer of the service, provided that doing so does not reduce mandatory consumer rights. Headings and the summary are for convenience and do not alter the numbered terms.

English is the source version of these Terms. A translation is provided for convenience unless applicable law requires the translated version to control.
